Nassau County Takes a Stand with
SOCIAL HOST BILL
Adults Allowing Underage Drinking in their Homes
Could Now Face Fines and or Jail Time
Although most parents of teenagers would not think it would be a
wise decision to serve alcohol to minors, the rate of underage alcohol
consumption is growing rapidly. A new bill passed unanimously by
the Nassau County Legislature on Monday, July 9 would now make it
not only an unwise decision but would make it an actual crime. The
"social host bill" as it is called, imposes a $250 fine for a first time
offense, which would be a misdemeanor, a $500 fine for the second
offense and up to $1000 for the third offense or possible jail time. The
law imposes the obligation of hosts 18 and over who knowingly serve
alcohol to anyone under the legal drinking age of 21. Certain exemptions
apply for alcohol served during religions ceremonies.
While this is a new bill for Nassau County it is not a new law for
many communities nationwide who have chosen to adopt this legislation.
Far too many students under the age of 21 are driving while
intoxicated and are causing serious injury or even death to themselves
or innocent victims. The intent of this legislation is to heighten awareness
of this growing problem on Long Island roadways and make students
as well as parents aware of the dangers of drinking and driving.
Testimony at the recent legislative session indicated that police
will enforce this law by responding to complaints rather than knocking
on doors and seeking out violators. For example if a minor returns
home from a party intoxicated and the parents notify the police, the
police will then investigate their complaint. In addition if an underage
driver was pulled over for a possible DWI and reported where he or
she was served alcohol that too, could warrant an investigation.
Should a parent discover drinking at a party the law requires that
the parent take reasonable corrective action including but not limited
to making a prompt demand that the minor either forfeit and refrain
from further consumption of alcohol or depart his or her home immediately.
If the minor does not comply with this request one must
promptly call his or her parent or legal guardian or the police.

members with Honorary Lifetime Membership awards for their dedicated service
to the children of Bethpage.
