March 13, 19lt^. .-^niith F. Pearsall, Esq.,
Editor of Nassau County Reivew. Freeport, N. Y. Dear Sir:-
Referring to llie coiiimunicatioB published in the last issue of your pa¬ per and signed "Village Voter." 1 wifih to have the privilege of making some remarks in reply thereto. In' relation to the matter of the Southern boundary of the Villsge of Freeport, I have at my own expense procured from the .Secretary of Stale'" oflice a certi¬ fied copy of a map bearniir date Aug- u.-<t, 1911, made b.v Sir''i*i Malcom¬ son. civil cngiiiei'rs, and ctfrtilicd Sep¬ tember bth, IDU, and certified In nie H9 11 Rienuine :opy by C W. Taft. As- sJis-tan; Deputy Secretary of State, March 20, 191.'). This map so far as I lui.-e who have examined it can d:s • ever differs materially from the bnun- (iurii Sl jjiven in the original article." of incorporation of the Village of Fr»e port, and winch articles arc filed inth* (jueens (_'ounty Clerk's OHice at Ja- iiiaicH, and I have had taken from said articlt-i a copy of the description of the original southern boundary of the village at (he time of the pniptiMed in- (•(irporatioii, and it ist certainlv a very interesting question to know by whose authority and when the Snuthern boiin- ilary of our village was channed with¬ out any apparent notice to the taxjiay- ers of the Village of Freeport. There are several questions involved in this matter, and in my judginent should liaw explanation. One of the import¬ ant ones, being as to the rights of the people living outside of Ihe original boundariea of the village at the time of Its incor; oration to vote in the vil¬ lage elections, and it itnpresses nie that if 1 were Htiioni; Hint iiuinher 1 slioLiid want u- '.now heyoM'^ • ly ques¬ tion ot doubt HS to whi'thei- I -a? vot¬ ing illegally or not. 1 am led to ije- ievf that this territory outside ot '.he original village limits ii- being eerved IpV our village policemen nnd otber vil- lagn officials, and <f this is true, is it not poaaible that this niight lead to some unpleasant complications nt some . fiiluri' date if some taxpayers shonld raise llie question as to th' funds of the Viliage of Kreeport being used for the proiection and maintenance of |ir.!jii'r(y outside of tbr village limits SB originally incorporated, and our !) londarlHii to the casual olisrrver seem to have been in some way or manner •.hui:;;e'i without any vote of the ir*e*- pie of tlie Village 6* Freeport l.fiiig lakti! Ihi-rcon. At least I tiave no recollection ot such vote having been taken at any r^-gular or special villaga e'ection since our incorporation. I would like to ask further if our vil¬ lage limits have been or can be changed without the taxpayer- of the village uving a Voice in such change/ What limit is there to be reacbfl liefore such act ion becomes illegal, in other words, if some person or persons has a right or assumiiit lo possess the right to take in, we will say. a hundred feet south of our village boundary withoot ! the comment of the taxpayers of the villago, what is to prevent some other person or persons of taking in a mil* south without having any cwWFPt vt I the taxpayers thereto, fl »*i\ft?easeB ' me that this is a vital matter which should be cleared up immediately so I that there will be no possible oppor- I tunity for any question to arise a* to the legality of persons casting their votes at the next village election.
I might say in closing as to the laat paragraph in the communication re¬ ferred to published in your paper that much to my surprise my representa¬ tive was informed that there waa noth- > ing on file in the Village Clerk'a office as to the original map or boundariea of the proposed village at the lime of the incor|Kiration, and this impreesca nu' HS being rather peculiar as one would naturally expect to hnd lOch description there, but I wan obliged to have representatives go to the (jounty Clerk's office at Jamaica to tind the original description of the propoied village at the time of its incorpora¬ tion.
If it should be explained that thla change was made to correct any mis¬ takes in the original description, which is by a survey also, then why was the same surveyor who rnadv thf lirst sur¬ vey uaed to make thi- second survey and how may we know thnt tl e second survey is now correct, and why were not thi peo[ile told aboul 'ucti change anyway?
If agreeable to you. I would appre¬ ciate your publishing this communica¬ tion in thf ntxt is-'ue of your good pa¬ pt-r bs itH publication will doubtU-s '.n some give lenlightenment upo', important mstt*-r.
Very, truly your«,
