Gulotta and Rozzi Demand
$1.3 Million in Compensation
Nassau County Executive Thomas
S. Gulotta and Police Commissioner
Samuel J. Rozzi today announced
that following extensive investigation
the Police, it has been determined that
the cause of the Seaford Propane
Truck Fire rests "squarely with a dereliction
in maintenance by Conservative
Gas." Gulotta and Rozzi indicated
that the County was seeking
$335,406. from Conservative Gas to
compensate the County and its residents
for expenses incurred during the
emergency, plus $1 Million in punitive
damages. He said the County would
file a lawsuit in Federal Court if the
company fails to pay.
"For over forty hours last month,
our residents confronted a major crisis
as the result of the overturned propane
truck.'* Gulotta said. "Residents
and families were evacuated, schools
closed, train service and lifestyles disrupted.
It was only through the textbook,
cooperative effort among our
emergency service workers, and our
residents, that not a single injury
occurred during this trying time."
The driver and the company were
cited with fourteen violations of New
York State Vehicle and Traffic Law
and Federal transportation law
including unqualified and unlicensed
driver; bare, loose and dangling wiring;
broken spring assemblies; operation
in condition likely to breakdown;
failure by company and driver to
properly inspect; no protection for
rear valving; (rollover protection) and
two defective valves.
"The final police report on this
incident clearly demonstrates that the
accident was caused by faulty maintenance
by Conservative Gas. In view of
this, it is our intention to seek a sum
total of $1,335 Million from the company
to compensate the County for
incurred expenses, and as punitive
damages as a result of their failure to
properly maintain vehicles carrying
hazardous materials in our County."
Police Commissioner Rozzi
declared that the police report clearly
spells out the root cause of the
accident.
"According to the official police
report, the accident was directly
attributed to an inadequately and
improperly maintained vehicle unfit
for transportation of hazardous materials
on a public highway, due to a
deficiency in the maintenance of the
shock absorber/spring system on the
passenger side of the vehicle. Futher-more,
the report shows that inadequate
roll-over protection, as required
by Federal Law, contributed to the
rupture of the tank and the subsequent
forty hour fire."
County Executive Gulotta
expressed grave concern that the
truck would be allowed to operate
under these circumstances. "Conservative
Gas was directly responsible for
allowing a vehicle carrying propane to
