Mental Health Center

at the Cditer's annual board of
directors' dinner-meeting. Swxart

of the presidency, the

FREEPORT - The private caning of village resident's garbage will
probably begin by March 15. Mayor William H. White said at Mondsy
night's village board'meeting. The prediction was'ln respon&e to a
scries of questions asked by a representative of the local CSEA unit.
White referred to a Supreme Court decision rendered earlier in the
day — Monday, March 5 — which
dismissed a petition brought
against the village by the CSEA.
"Now." White said, "he (the
private carter. Five Counties
Carting] can go full blast."
. Although the contract with Rve
Counties was approved by the
board of trustees on January 29,
two law suits had sloM^ed down its
implementation. The CSEA case
was the second of the tM-o. both of
which have Ijcen decided in the
village's favor.
, The CSEA had claimed that the
village's contract with . Five
Counties was the awarding of a
"franchise." for which there
must first be. their brief said, a
public hearing.
In his decision. Judge Beriuud
McCaffrey quoted Webster's
definition that a franchise b a
contract for public woriu or public
services. Semantics should not t>e
the issue, the Judge said, basing
his decision instead on sections of '
the State village law which says
that a village can collect garbage
either directly through its employees
or by contacting contracting
with another person. Another
section of the law, McCaffrey
pointed to as he dismissed the
CSEA's petition, specilies the
powers of the t>oard of trustees
and allows them to grant such a
contract.
In the other sanitation law suit,
a Freeport resident,-Dorothy
Green, had asked to "have the low
bid voided because the bidder did
not submit a complete operational
~ plan explaining exactly how each
odDection route would be covered.

the award of the contract to the
low bidder, rather than a higher
bidder, was in the best Interests

about $450,000 a year (over what
had been estimated the municipal

State Supreme Court Justice
Andrew DiPaola dismissed the
law suit, stating that there were
no legal- gtounda. DlPabla .said

discretion of the village board.
A village spokesperson pointed
out this week that the- current
issue of Reader's Digest contains
an. article detailing now municipalities
throughout the nation are
going to private carting for the
:economics realized.

Schrank. of the CSEA. Monday
evening that the carter's performance
l>ond will be delivered
with the contract. He agreed that
it would only be for the first year
pointing out that the contract
specified that the bond be posted
for each year in the amount of
each year's contracted cost.
