I 6S. L,ands to be acquired: e»>mmisaion. Whenever lands, and the structures and waters thereon, altuated within the bound¬ aries of this atate, are, in the judgment ot the governor, necessary for purpoaea of public defenae, the eatates, titles and Intereats In and to auch landa, atructurea and Waters,, belonging to or vested in any peraon, corporation or municipality, may be acquired by the state as providwl In thia article. Th. governor shall, when¬ ever certain lands and the structures and waters thereon, to be designated by him, are required for auch purpoaes, direct tha adjutant general, th. state engineer ai)d th. superintendent of public works, to take such actiona and Institute such pro¬ ceedings aa may be necessary to acquire auch landa In the name and for the bene¬ fit of the people of the state. When directed by the governor to acquire certain designated lands, and the structures and waters th«rw>n, for the purpoaea of public defense, as herein¬ before prescribed, th. commission shall cause a survey and map of such landa to b. mad.. The mem)>«rs of auch commis¬ sion and its duly authorized agents and employsM may enter upoit such lands. and the structures and lyaters thereon, for the p.urpose of makln|[ auch survey and map.' The atata engineer shall annex to such survey and map his certlflcate aa, to the accuracy thereof. There shall be' annexed thereto a certlflcate- executed by th. members of th. commission, stating that th. lands and the structures and waters thereon, described In such survey and map, are necessary for purposes of public defense. The original of such survey and map and the rertiflcatea an¬ nexed thereto ahail be submltte>d to the governor, and tf approved by him. It ahall be flled in the offlca of the secretary of atate. I M-b. Purchase or soqulaltion of lands; payment of purchase price. The commis¬ sion shall caus. an appraisal to be mad. of the value of the lands and structures and waters thereon, appropriated by the state as hereinbefore provided, and of the estates and interests thsrein of ail per¬ sons, corporations or municipalities. The commission shall negotiate with the own¬ ers of such property for the purchase thereof, but In no caa. shall an amount greater than the appraised value of auch property b. paid. The commission and the rersona, corporationa and municlpali- tiea whose property has been appropriat¬ ed and who have agreed upon a compen¬ sation to be paid therefor, shall enter Into an agreement for the conveyance or transfer of the property appropriated and for the payment of th* compensation to be paid, which shall be exescuted by the commission and the said owners. Bach agreement shall be flled in the offlc. of the comptroller. If ^he commission la unable to agree aa to the compensation to be paid for such lands and the struc¬ tures and waters thereon, the court of claims shall have Jiirisellctlon to deter¬ mine the amount ot such e'ompen8atie>n, and upun preK-eedlnRS beinK brouBht before such court as provided by law. an award shail be made of compensation foi* the lands, structureb and waters so approprlr ated.
The persons, corporations or munici¬ palities who.se property has been taken under the provisions of this article, and who have agreed upon th« i"ompennatlon to be paid therefor or to whom an award of oompensatlon has been made by the court of claims, bhall be entitled to Inter¬ est from the time of the nctual oi-t-ei- panc,v thereof by the state to the date of the payment of the said compenRation: but such interest ahnll cease upon the service by th* comptroller upon the per¬ son, corporation or municipality entitled thereto of a notice that the state is rejiely and willing to pay the amount of such compensation upon the presentation of pioper proof anei vouchers.

The governor may, If requested b.v any offlcer or agent of the United States duly authorized un¬ der the hand and seal of any head ot an executive department of the government of the United States, execute a de^ br release to the gov^rnmegt of the United States of the lands and the structures and waters thereon, descrll)ed In the sur¬ vey and map tiled In the offlce of the sec¬ retary of state as hereinbefore provided. Such deed or release may be so executed at any time after the commission shall have entered upon and taken i>088e;.sston of such lands, structures and waters. Such deed or release shall be In the form agreed upon by th* governor and the proper representative of the government of the United States and shall convey title to the lands, structures and waters described therein to the government of the United States, to be used for pur¬ poses of defense, and shall cede to the United States the Jurisdiction over th* tracts or iMircels of land so described, to the extent and In th* manner hereinafter provided. Such deed or release ahall be executed in duplicate In the name of the stat. and under Ita great seal. One of such duplicates .shall be flled and recorded In the offlce of the secretary of state of the stat* of New York, and the other shall be delivered to the proper executive department of th* government of the United SUtes.
I B9-e. Concurrent Jurisdiction as to service of process. The Jurisdiction so cedeei shall be upon the express condition that the state of New York shall retain concurrent Jurisdiction with the Unlteei States on and over th* property and premlswi so conveyed, so far as that all civil and criminal process, which may Issue under the lawa or authority of the state of New Yprk, may be executed thereon in the aam* manner aa If such Jurisdiction had not been ceded, except so far as such process may affect the real or personal property of the United Statea.
I 69-f. Slxemptloa of property from state taxation. The property so conveyed and released to tb* United SUtes shall be ex¬ empted from all taxes, assessments and other charges, which may be levied or imposed under the authority of this state; but the Jurladictiun hereby c*ded and the exemption from taxation hereby granted shall continue in respect to auch property so long aa the aame ahall remain the property of tbe United States and be used for purposes of public dsfens*. and no longer.
