Conditions Not Complied With.
In both of these cases the claims for the value of land under water cov¬ ered land which the state had granted for a trifling consideration upon the condition that the grantees sJiou'.d within a certain definite time make certain Improvements upon the land eo granted, which condition, tho ttate claims, waa not complied with.
To Protect the State'a Interests.
For the future protection of tho state In cases of thla kind, Attorney Ceneral Lewis prepared the present law. which makea it the dutr of the Secretary ot State annually to prepare and deliver to the State Engineer a ll»t of all grants of land under water which contain conditions to be com¬ piled wltJj within nxed periods of time. The State Engineer Is required toy this law to examine the land* cov¬ ered by each of such granta for the purpose of ascertaining whether or not there has been a compliance with Buch terms and to certify to ths Attor¬ ney Oeneral a list of all such gnanta oontalulng conditions wbidi have not beea performed.
Suits to Recover Lands.
Tho Secretary of State ha* prepared BU(rli a list, and the SUte Engineer has completed the examination of the lands certified to him and has found that in Richmond county alone there are 118 Rrants, the prantees of which have failed to comply with the condi¬ tions, with the result tliat the At¬ torney Is now preparing the papers lo commence action for the recovery of the lands.
In oonnectioM with this work the State Engineer haa provided for tlie standardization of map« of lands un¬ der water, to be Bubmltted when appli¬ cation ia made/for a grant. Hereto¬ fore grants wbre made upon maps prepared by the applicant and were not alwaya uniform in the data fur- nish-od. Now all maps are prepared by the State Engineer, insuring uni¬ formity and accuracy, but are paid (or by the applicant.
