Renew Legal Action
Against Fertilizer Plant
The Incorporated Village of
Farmingdale this week filed a
motion for a summary judgment
against Lebanon Chemical Corporation,
Lee 0; Karp, Morris
Karp, and Morris Karp & Son,
Inc., charging them with ' illegal
use of the property' at 81
Secatogue Avenue, Farmingdale.
The parties were served with a
summons and complaint earlier
this year and the complaint called
for the stoppage of the " illegal
use of the premises for the storage,
manufacture of fertilizer and
fertilizer products."
Village officials retained the
law firm of Charles V. McDonald
of Freeport over a year
ago to represent them in the
proceedings. The law firm then
served notice on the parties concerned
this past spring. The defendants
then asked for a Bill
of Particulars and then asked
the Village Board to stop the
proceedings because the Village
Board of Appeals was looking
into the matter.
According to the law firm, the
new motion was filed because
the defendants admitted the
charges on the basis of the answers
they had presented after
having been issued a Bill of
Particulars.
The motion was returnable on
Friday, October 27, butarequest
for adjournment was granted and
the case is scheduled to be heard
before the Supreme Court of
Nassau November 9.
The charges were brought to
a head after village officials
acted upon the complaints of
residents in the Sullivan Road
sector of the village who complained
about noxious odors from
the plant causing them undue
hardship and creating a menance
to their health.
