BOND RESOLUTION DATED
OCTOBER 24, 1967.
A RESOLUTION AUTHORIZING
THE ISSUANCE OF
$ 500,000 SERIAL BONDS OF
THE TOWN OF OYSTER BAY,
NASSAU COUNTY, NEW
YORK, TO PAY A PART OF
THE COST OF THE INCREASE
AND IMPROVEMENT OF THE
FACILITIES OF THE MASSA-PEQUA
WATER DISTRICT IN
SAID TOWN.
WHEREAS, by proceedings
heretofore duly had and taken
pursuant to Article 12 of the
Town Law, the Town Board of
the Town of Oyster Bay, Nassau
County, New York, has determined
it to be in the public interest
to increase and improve
the facilities of the Massapequa
Water District of said Town as

hereinafter described; and
WHEREAS, said Town Board
duly adopted a bond resolution
dated August 23, 1966 ( Resolution
# 1382- A- 1966), authorizing
said increase and improvement,
at a maximum estimated cost of
$ 950,000 and authorizing the issuance
of $ 950,000 serial bonds
of said Town to pay the cost
thereof; and
WHEREAS, subsequent to the
adoption of said bond resolution,
said Town Board duly adopted
Resolution # 93- 1967, dated June
13, 1967, authorizing the issuance
and sale of $ 450,000 serial
bonds of said total authorized
issue of $ 950,000 serial bonds
as a part of a consolidated issue
of $ 2,797,436 Public Improvement
( Serial) Bonds, 1967, dated
June 1, 1967, which bonds have
been duly sold and delivered; and
WHEREAS, it is now desired
to adopt a further bond resolution
providing for the issuance of
$ 500,000 serial bonds for the
aforesaid specific object or purpose,
being the balance of said
original authorization of $ 950,000
serial bonds; NOW, THEREFORE,
BE IT
RESOLVED, by the Town Board
of the Town of Oyster Bay, Nassau
County, New York, as follows:
Section 1. The specific object
or purpose to be financed, in
part, pursuant to this resolution,
is the aforesaid increase and
improvement of the facilities of

the Massapequa Water District
in the Town of Oyster Bay, Nassau
County, New York, consisting
of the installation of a deep well,
pump house, one million gallon
elevated storage tank, transmission
mains and necessary appurtenant
facilities.
Section 2. The maximum estimated
cost of such specific object
or purpose is $ 950,000, and
the plan for the financing thereof
consists of the issuance of the
aforesaid $ 450,000 bonds heretofore
issued and by the issuance
of an additional $ 500,000 serial
bonds, as a second series, hereby
authorized to be issued therefor
pursuant to the Local Finance
Law.
Section 3. It is hereby determined
that the period of probable
usefulness of the aforesaid specific
object or purpose is forty
years, pursuant to subdivision 1
of paragraph a of Section 11.00 of
the Local Finance Law, computed
from January 20, 1967, the date
of the first bond anticipation note
issued for such specific object
or purpose. It is hereby further
determined that the maximum
maturity of the serial bonds
herein authorized will exceed
five years.
Section 4. The faith and credit
of said Town of Oyster Bay, Nassau
County, New York, are hereby
irrevocably pledged to the
payment of the principal of and
interest on such bonds as the
same respectively become due
and payable. An annual appropriation
shall be made in each
year sufficient to pay the principal
of and interest on such
bonds becoming due and payable
in such year. There shall annually
be apportioned and assessed
upon the several lots and parcels
of land in said Massapequa Water
District especially benefited by
the aforesaid improvements in
proportion to the amount of benefit
which said improvements
shall confer upon the same, and
in the manner provided in the
Town Law, an amount sufficient
to pay the principal of and interest
on such bonds as the same
shall become due and payable. In
the event that the annual collection
of such assessments shall
be less than the amount required
to pay the principal and interest
on such bonds as they shall become
due and payable, the Town
Board shall direct that surplus
moneys not otherwise appropriated
be applied.
Section 5. Subject to the provisions
of the Local Finance Law,
the power to authorize the issuance
of and to sell bond anticipation
notes in anticipation of the
issuance and sale of the serial
bonds herein authorized, including
renewals of such notes, is
hereby delegated to the Supervisor,
the chief fiscal officer.
Such notes shall be of such
terms, form and contents, and
shall be sold in such manner, as
may be prescribed by said Supervisor,
consistent with the provisions
of the Local Finance Law.
Section 6. The validity of such
bonds may be contested only if:
DSuch bonds are authorized
for an object or purpose for
which said Town is not authorized
to expend, or
2) The provisions of law which
should be complied with at
the date of publication of
this resolution are not substantially
complied with,
and an action, suit or proceeding
contesting such validity is commenced
within twenty days after
the date of such publication, or
3) Such bonds are authorized
in violation of the provisions
of the Constitution.
Section 7. The aforesaid bond
resolution dated August 23, 1966
( Resolution # 1382- A- 1966), to the
extent that indebtedness has not
already been contracted thereunder,
is hereby superseded and
repealed.
Section 8. This r e s o l u t i o n,
which takes effect immediately,
shall be published in full in Massapequa
Post and Massapequa
Observer, together with a notice
of the Town Clerk in substantially
the form provided in Section
81.00 of the Local Finance Law.
