CNell said he made bl.n companions, Hoffman and Salerno as well as the automobile thieves In Brooklyn from whom they got the car, come In with a share of the money that wa.s paid back to Harvey on the ground that he was a "good fellow" and had helped them when they were in trouble.
He also swore that through Harvey thfey arranged to pay Carman I'lant $36 a week as "protection" money for the privilege of selling stolen cars In Nassau County.
Askfd on cross-examination If he thought Harvey ever proflted a nickel by the money he passed, O'Neil .said he was sure that Harvey did not profit and {from |^e 'teetiniony it appears that Harvey not only lost out from all angles, but that he had a lot of trouble besides the criminal charge again.st him now.
He denied that hn wanted to .send Harvey to Sing Sing prison but added: "They all ran out on me. when 1 got In trouble and they can t^ke care of themselves now."
O'Neil denied that he camo to court with a vicious purpose or that he want¬ ed to "get .square on" anyone. He maintained that "he Was tellingi flhe truth which Is the statement that he has repeated and reiterated many times during the two trials of Plant and the hearings that he has participated in. O'Neil denied that he had been prom¬ ised Intercession for a shortened sen¬ tence If he testified and said, "1 haven't been promised anything. I'm telling the truth through respect for my family."
Hoffman corroborated O'Neil in rv erything he had said and the cro.s.s. examination left them stronger If any¬ thing thaa before.
Salerno corroborated tho tale also ln.sorar as hc knew It, although he did not seem to have as thorough a know]. edge of what was ¦ being done by ^his partners as he might hnve had.
Aubrey Pettlt al.so corroborated O'Neil. He said that Harvey came to him at the Belmont track and told him that Plant wanted O'Neil to get out of tha Freeport charge and l.ator when he .saw Harvey the latter gavo him $200 with the Instruction to give it to Plant which Pettit says he did at the Court House.
Plant told much the .same story. He .said Harvey came to him asking him to Intercede for O'Neil, that ho did so.

Iff Harvey at the Belmont track In September, 1919, and told him that he wanted to escape the charge because he wanted to avoid Indictment as a second offender. Later he saw Har¬ vey talk to Pettit and then to Plant in the paddock at the race track. After that he met Harvey in Tangeman'a Hotel In Flushing and there Harvey told him It would cost $200 to get out of the Freeport charge. O'Neil swore he wanted to pay the money at onoe, but Harvey refused to take the sum until after O'Neil had been dismissed from court.
O'Neil al.so swore that Plant did get him out of the Freeport trouble by telling Judge Flint that he could l>e useful In getting ,the real criminal. Following that O'Neil swore he went to Flushing, sought out Harvey and paid him the $200 as agreed. He was accompanied by his "pal," Hoffman.
Then the witness swore that Har¬ vey said he would like to have a Hud¬ son car, that they got one, told Har¬ vey it was a stolen car and sold it to him for $600, although it was worth
